As defined in the notary statutes, a notarial act is any act that a notary public of this state is authorized to perform, including taking an acknowledgement, admininstering an oath or affirmation, executing a jurat or taking a verification upon oath or affirmation, witnessing or attesting a signature, certifying or attesting a copy, and noting a protest of a negotiable instrument.

Yes. The statutes require that the Notary Public see the signer actually sign the document when the notarial working is that of a JURAT.  In the case of an acknowledgement, the person is simply acknowledging (declaring, stating) that he or she singed the document. If the Notary Public do not know the signer, that person must also show indentification and sign the Notary Public journal.

The law requires an identification card with a photo and signature.

The statute doesn’t address expired IDs. The notary have to make the determination of whether the ID presented is satisfactory or not. The Notary must be satisfied that the person making the acknowledgement/verification is the person whose signature is on the document.

A power of attorney (POA) is a legal document that allows a principal to choose a POA who they trust to handle their affairs for them12. It is used in the event of a principal’s temporary or permanent illness or disability, or when they can’t sign necessary documents1. A POA can be used for almost any financial purpose, including signing legally binding documents, operating bank accounts, paying bills, buying and selling real estate, managing investments, and collecting rent3. A POA can also be used to represent or act on another’s behalf in private affairs, business, or some other legal matter.

An Apostille is a legal certification that makes a document from one country valid in another (provided that both are signatories to the 1961 Hague Convention Abolishing the Requirement for Legalization for Foreign Public Documents).

Child travel consent form   

If you travel or are going to travel with a child, consider taking the following documents:

  • If the child is traveling with only one of their custodial parents, they must have a letter of consent, preferably in English and notarized, from the other parent or signed by both parents. …
  • If one parent has sole custody of the child, a copy of the custody document can take the place of the other parent’s letter.

An affidavit is a written statement filed by an affiant as evidence in a court case. In order to be admissible, affidavits must be notarized by a notary public. The purpose of a jurat is for an affiant to swear to or affirm the truthfulness of the contents of an affidavit.

A notary acknowledgement ensures that the signer of the document is indeed the person named in the document. The function of the notary in this case is to verify the identity of the signer. On the other hand, a notary is asked to perform a Jurat, when the signer takes an oath or makes an affirmation.

Marriage and Divorce Records

Please note that marriage and divorce records are held at the county level. For certified copies of marriage certificates, you must write to the County Recorder in the county where the license was purchased. For divorce records, you must write to the County Clerk in the county where the divorce was granted.

How do I search & order recorded documents in Washoe?

You can use the Washoe County self-service portal, and easily search Washoe County real estate, marriage and other records online. You can also order over the phone or send the County a request via email or mail. If requesting via mail or email, The Washoe County ask that you complete this document request form.

Marriage Certificates

Marriage certificate indexing data for documents recorded after 1965 is available to view on the Washoe County Recorder self-service portal. Should you order a plain copy, a statutory fee of $1.00 will be charged. If you want a certified copy, a statutory fee of $15.00 will be charged.

Divorce certificate or certified copy:

For divorce records, you must write to the County Clerk in the county where the divorce was recorded.

Can a RON be conducted in any state?

Yes!

No matter which of the 50 states you call home, your documents can be remotely notarized. The only geographically constrained member of the transaction is the remote online notary themselves. As per the law, the notary must be within the borders of the state in which they are commissioned to perform remote online notarizations during the notarial act.

Remote online notarization permits anyone to get a document signed, verified, and sealed from the comfort of their own home or office. Signers meet a licensed notary online, present their ID and documents, and sign their papers digitally. After that, the notary verifies their identity, signs, and digitally notarizes the document. It all happens securely online with audio-video technology.

A notary conducts a lawful RON if they are physically located within one of the 41 RON enacting states. However, a signer physically located in any state may lawfully access a notary in a RON state to have an online notarization performed.

Where does the notarization have to take place?

The notarial act takes place in the location of the notary. Therefore, the laws of the notary’s commissioning state govern the validity of the notarial act. With RON, the signer’s physical location does not determine the law that applies to the notarial act.

According to RON laws, the requirement for a personal appearance no longer requires a face-to-face meeting with a notary. With RON, the definition of ‘personal appearance’ broadens. Audio-visual technology can satisfy the requirement for face-to-face contact. Physically, a signer can be located in another town, state, or even another country from where the notary is based.

What states have RON laws?

Visit MBA’s RON Adoption Map to see which states have RON laws. It also shows which states are in the progress of adopting RON. Similarly, you can visit your state’s secretary of state’s website to learn more about your state’s RON laws. Notaries must complete training to understand the requirements and legal issues surrounding remote online notarization. 

States that permit RON have stringent requirements for notaries, and the notaries must show the platform they’re using meets the state’s standards for security and identity verification protection. They also maintain an online notary journal or eJournal. Therefore, they report every notarization. The eJournal is part of the platform use to conduct RON and is available to the notary as part of dashboard access. It also includes the ability to download it if needed.

Remote online notarization adoption continues to progress, with the remaining states actively working through legislation to pass their RON laws. RON platforms provide security, speed, fair price, safety, and convenience to organizations and their clients.  Also, when conducting a remote online notarization, the client can do it in the privacy of their home or office. They don’t have to worry about conducting private business in a public space.
